NQ Legal will complete a property title search as part of our state-wide conveyancing services, however sometimes, depending on the location and nature of the residential property, additional conveyancing searches may be required.  Property conveyancing is a vital process in the sale or purchase of your home therefore it is important to ensure your conveyance has been thorough.

Title Search x 2 This gives a description of the property and lists, the title reference, the registered owner, encumbrances, registered leases and caveats. It is important to see if there are any of these interests over the property before the purchase goes unconditional to ensure there are no other interests listed that could affect your interest on title. Once the contract is signed and the day of settlement $29.25 x 2
Registered Plan This shows the location of the land and allows you to identify if it is the correct block Once the contract is signed $30.05
Bankruptcy Search This search establishes whether the seller is listed on the Insolvency and Trustee Services Australia Bankruptcy Register. Once the contract is signed FREE
QLD Court Search This search establishes whether or not the seller or the property is the subject of an ongoing civil claim. Once the contract is signed FREE
Company Search                       (if required) If either party is a company this search confirms the registered company name and that the ACN matches that is stated on the title of the property and who is authorised to sign on behalf of the company. Once the contract is signed $22.10
Pool Safety Register                 (if required) This will determine whether a current Pool Safety Certificate is in effect in respect of a pool Once the contract is signed FREE
STANDARD MAPS WE GENERATE AS WE OPEN YOUR FILE:
QLD Transport Map This map verifies whether or not the Department of Transport and Main Roads has, or may have a land requirement for the property in relation to transport and road infrastructure. Once the contract is signed FREE
TCC Services Map               (TCC properties only) This map shows where the sewage line and water connection is for the property. Once the contract is signed FREE
TCC Flood Map                    (TCC properties only) This map show the storm tide evacuation zones for your suburb (if applicable). Once the contract is signed FREE
STANDARD SEARCHES WE COMPLETE ONCE THE CONTRACT IS UNCONDITIONAL:
TCC Standard Rates This search provides local government information:

  • Rates, stormwater, sewerage, water, roads, service plans;
  • Financial information, ownership, valuation details;
  • Flood hazard assessment and storm tide inundation assessment for the property.
  • Heritage search which verifies whether or not the property is listed on the Townsville City Council Local Heritage Database.
  • Planning services, including zoning, landslide hazard zoning, heritage listings; and
  • Health services including premises registration, vacant land, and overgrown allotments.

This search will be relied on for the purpose of calculating an adjustment at settlement. If there are rates owing an adjustment will occur in your favour at settlement.

Once the contract is unconditional                                (5 day turnaround) $190.80
 Land Tax Certificate  This certificate confirms if there is land tax owing over the property. If there is tax owing an adjustment will occur in your favour at settlement. Once the contract is unconditional.  $51.26
Body Corporate Info Certificate (Form 13)               (if required – Unit only) The certificate provides financial and management information relating to the Body Corporate and is only relevant for a UNIT or TOWNHOUSE. This search will be relied on for the purpose of calculating an adjustment at settlement. Once the contract is unconditional. $100.00
ADDITIONAL SEARCHES:
Instrument Search (advisable if there is an instrument on title) For details of encumbrances reregistered on title. Once the contract is signed. (takes 1 business day) $51.75
LOCAL GOVERNMENT ADDITIONAL SEARCHES:
TCC Special Water Meter Reading Actual water consumption since last meter reading. Once the contract is signed. (takes 5 business days) $154.33
TCC Final Certificate    (advisable if there is a dwelling on the property) Copy of final inspection certificate and Building permit. Once the contract is signed. (takes 10 business days) $74.20
TCC Building Search Application, Decision notice(s), Plans and final inspection certificates and building permit. Once the contract is signed. (takes 10 business days) $164.80
TCC Building File Search Application, Plans, Decision notice(s), Plans, final inspection certificates , building permit, termite and soil reports Once the contract is signed. (takes 10 business days) $235.80
TCC Town Planning Search (Limited) Limited search – summary of the provisions of planning scheme and regulatory provisions applying, any designations applying to the premises. Once the contract is signed. (takes 5 business days) $262.80
TCC Town Planning Search (Standard) As per limited search plus copy of decision notices for current and declined development approvals, copy infrastructure agreements, infrastructure charges details. Once the contract is signed. (takes 10 business days) $1,583.80
TCC Town Planning Search (Full) As per limited and standard searches plus statement re (non)fulfilment of any current development conditions, details of infrastructure agreements, advice of prosecutions for development offences. Once the contract is signed. (takes 30 business days) $3,046.80
Local Govt. Vegetation Protection Orders Whether vegetation on property is protected or subject to an order. Once the contract is signed. Price available on enquiry

BODY CORPORATE ADDITIONAL SEARCHES:
Body Corporate Records Search Levy information, by-laws, lot entitlements, insurances, details of management and letting agreement, referee’s orders, special levies. Once the contract is signed. (takes 10 business days Price available on enquiry
Body Corporate Orders from Body Corporate Commissioner Orders made against a community titles scheme. Once the contract is signed. (takes 4-5 business days) $26.52
Title search (common property) for scheme Any encumbrances registered on common property, e.g. mortgages, easements. Once the contract is signed. $27.05
Building Management Statement Governs relationship of the scheme with other volumetric lots on the property. Shows any shared areas or shared services. Once the contract is signed. $52.31
UTILITY PROVIDERS ADDITIONAL SEARCHES:
Energex/ Ergon
  • If the property is connected under normal tariff conditions;
  • if the property is connected under guarantee conditions and the amount of the guarantee;
  • if the property is not connected, upon what conditions it may be connected; and
  • if there are any underground cables running through the property.

Powerlink Information concerning the Authority’s future interest in the property, easements and transmission lines. Once the contract is signed. (takes 10 business days) $49.34

 STATE GOVERNMENT ADDITIONAL SEARCHES:
Queensland Building Services Authority (only if property built <6 years and 6 months) Details of insurance cover for the property under the QBSA Act. Once the contract is signed. (takes 7 business days)  $59.35
QCAT Neighbourhood Dispute Resolution To check if there are any prior or current disputes over the property. Once the contract is signed. (takes 10 business days) $23.72        per Seller
QCAT Tree Register(www.qcat.qld.gov.au) To check for tree, dividing fences and pool fencing orders under the Neighbourhood Disputes Resolution Act 2011 or the Building Act 1975. Once the contract is signed. FREE
Physical inspection of QCAT records in QCAT registry To check for tree, dividing fences and pool fencing applications under the Neighbourhood Disputes Resolution Act 2011 or the Building Act 1975. As close as possible to settlement, ensuring enough time to receive results prior to settlement. Price available on enquiry
Contaminated Lands Search (advisable for redeveloped farming  / industrial use site) ‘Contaminated land’ refers to land contaminated by hazardous substances which may pose a risk to human health or the environment. This search will confirm whether the property is listed on the Department of Natural Resources and Mines Contaminated Land register. Once the contract is signed. (takes 1 business day)  $68.09
 Noise Corridor Search – Department of Planning and Local Government(www.dlgp.qld.gov.au) The search will determine if the property is in a designated transport noise corridor.  Once the contract is signed.  FREE
Heritage Register               (QLD EPA) (relevant if dwelling more than 50 years old). Current listing on register, heritage agreements, prohibitions on use. Once the contract is signed. $57.09
National Heritage Listing Information on indigenous, natural and historic sites on the register. Once the contract is signed. Price available on enquiry
Coastal Management Search(advisable if property is located in a coastal area – beach or harbour) Whether the land is within a coastal management control district or an erosion-prone area and therefore the provisions of the Coastal Protection and Management Act 1995 applies. Once the contract is signed. FREE
Coastal Protection (Sanctions on construction of jetties)
  • the date of any sanction issued; &
  • nature of the works sanctioned.

ATSI Cultural Heritage Register and Database (DERM) Information about the location of significant ATSI cultural heritage sites. Once the contract is signed. FREE
